Smart Insurance Agents LLC ("we," "us," or "our") is an independent insurance agency headquartered in Illinois and licensed in 40 or more states. This Privacy Policy explains how we collect, use, store, and share your personal information when you visit getsmartquotes.com, submit a form, call or text us, or work with us on Medicare or employer health coverage.
As a licensed insurance agency, we are subject to the Gramm-Leach-Bliley Act (GLBA) and to state insurance privacy laws, which govern nonpublic personal information such as your Medicare number, date of birth, and health information. Where those laws apply, they control how we handle that information, and this policy is meant to be read alongside them.
2. Information We Collect
2.1 Information you provide
Depending on what you ask us to do, we may collect:
- Name, phone number, email address, and mailing address
- Date of birth and, for Medicare work, your Medicare number and current plan information
- Health information needed to compare plans or complete an application, such as medications, providers, and conditions relevant to underwriting
- For employer plans, business information and an employee census (ages, ZIP codes, and coverage tiers)
- Payment or billing information when you pay a premium or fee through us
- Your contact preferences, including consent to receive calls and text messages
2.2 Information collected automatically
When you visit our website we automatically collect IP address, browser and device characteristics, operating system, approximate location, pages visited, and referring pages, through cookies and similar technologies described in Section 8.
2.3 Call recordings
Medicare-related calls are recorded for quality and compliance purposes, as required by Centers for Medicare & Medicaid Services (CMS) rules for third-party marketing organizations. Recordings and Scope of Appointment forms are retained for at least ten years as those rules require. Small business and employer plan calls are not recorded.

We use your information to:

- Complete enrollments and applications you ask us to submit
- Service your coverage after enrollment, including renewal and Annual Notice of Change reviews

4. Consent to Calls and Text Messages
By providing your phone number on our forms, you agree to receive calls and text messages from Smart Insurance Agents regarding your inquiry, including through automated technology. Consent is not a condition of purchase. Message frequency varies and message and data rates may apply. You can withdraw consent at any time by replying STOP to any text or by asking us to stop calling. Our SMS Privacy Policy describes our text messaging program in detail.
5. How We Share Information
We do not sell your personal information, and we do not share phone numbers or SMS consent with third parties or affiliates for their marketing. We share information only as follows:
- Insurance carriers and enrollment systems. To obtain quotes and submit applications, we share the information required by the carriers you choose and by Medicare, Healthcare.gov, or state exchange enrollment systems.
- Service providers. Companies that operate parts of our business on our behalf, including web hosting, form processing, customer relationship management, appointment scheduling, workflow automation, email and text messaging, and website analytics. They may use your information only to provide those services to us.
- Legal requirements. When required by law, regulation, subpoena, court order, or a state insurance department or CMS audit, or to protect our legal rights.
- Business transfers. In connection with a merger, acquisition, or sale of all or part of our business, subject to this policy.
6. Data Retention
We keep personal information for as long as needed to serve you and to meet legal, regulatory, and carrier requirements. Insurance application and enrollment records, Medicare call recordings, and Scope of Appointment forms are retained for at least ten years. Website inquiry data that does not result in an enrollment is retained for up to three years unless you ask us to delete it sooner. We then delete or de-identify information unless the law requires longer retention.
7. Data Protection and Security
We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including encrypted transmission, access controls, and vendor agreements that require confidentiality. No method of transmission or storage is completely secure, and we cannot guarantee absolute protection against unauthorized access.

10. Children's Privacy
Our services are for adults. We do not knowingly collect information from anyone under 18 except as a dependent listed on an application by a parent or guardian. If we learn we have collected information from a minor outside that context, we will delete it promptly.
11. International Users
Our services are offered to United States residents, and our systems are located in the United States. If you access the website from outside the United States, you consent to the transfer and processing of your information in the United States.
12. Changes to This Policy
We may update this policy from time to time. The "last updated" date at the top shows the current version. Material changes will be posted on this page, and where required we will notify you directly.
